Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of Capitalize (capitalize.media), operated by BSS Servicos de Consultoria e Tecnologia LTDA (“we”, “us”, “our”). By creating an account or using our service, you agree to these Terms. If you do not agree, do not use the service.

2. Service Description

Capitalize is an e-commerce analytics platform that connects to your Shopify store, advertising platforms (Meta Ads, Google Ads, TikTok Ads), and analytics services (Google Analytics) to provide a unified dashboard with KPIs, financial reports, and performance insights.

3. Account Terms

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old or the legal age in your jurisdiction to use the service.
  • One person or legal entity may maintain multiple brand accounts (tenants), each with its own subscription.
  • You are responsible for all activity that occurs under your account.

4. Subscriptions and Billing

  • Capitalize offers a 14-day free trial. No credit card is required to start.
  • After the trial, a paid subscription is required to continue using the service.
  • Subscriptions are billed monthly or annually via Stripe.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We do not offer refunds for partial billing periods.
  • We reserve the right to change pricing with 30 days’ notice.

5. Data and Integrations

  • By connecting a third-party platform (Shopify, Meta, Google, TikTok), you authorize us to access and sync data as described in our Privacy Policy.
  • We access data in read-only mode. We do not modify your store, campaigns, or any external data.
  • You may disconnect any integration at any time via Settings. Disconnecting removes the synced data from our platform.
  • Data accuracy depends on the third-party platforms’ APIs. We do not guarantee the accuracy or completeness of data provided by external services.

6. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose.
  • Attempt to gain unauthorized access to other users’ accounts or data.
  • Reverse engineer, decompile, or disassemble the service.
  • Use automated means to access the service beyond the provided APIs.
  • Resell or redistribute the service without our written consent.

7. Intellectual Property

The Capitalize service, including its design, code, and branding, is owned by BSS Servicos de Consultoria e Tecnologia LTDA. You retain ownership of your data. We claim no intellectual property rights over the data you provide or sync through the service.

8. Limitation of Liability

The service is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill.

Our total liability for any claim arising from the service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by third-party services (Shopify, Meta, Google, etc.).

10. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time by canceling your subscription and contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the dashboard at least 30 days before taking effect. Continued use after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes shall be submitted to the courts of the city of São Paulo, SP, Brazil.
